Citing “soaring” medical liability insurance costs and “runaway lawsuits,” Rep. Michael Burgess, M.D., (R-TX) this week introduced medical liability reform legislation that would cap non-economic damages against any single health care provider at $250,000 and wrongful death total damages at $1.4 million. In the case of wrongful death damages, the limit would be adjusted annually for inflation.
Similar to legislation enacted in Texas, the Medical Justice Act (H.R. 3509) also would provide certain instructions for juries to consider in their deliberations and criteria for expert opinion and testimony in medical liability cases in civil court.
